KNOW YOUR WEINGARTEN RIGHTS!
If you are ever called into a meeting with any management person to be questioned or investigated, it is your personal obligation to request union representation. Union representation is your right. You may quote the following to management:
“If I believe this meeting/discussion could in any way lead to any disciplinary action up to and including suspension or termination, I respectfully request that my Union representative be present. Without Union representation, I choose not to participate in this meeting/discussion.”
This is based upon your Weingarten Rights. These rights guarantee you Union Representation.
WEINGARTEN RIGHTS: In 1975 the U.S. Supreme Court issued its decision in NLRB v. J. Weingarten, Inc., 420 U.S. 251 (1975). The Court held that an employer violated Section 8(a)(1) of the National Labor Relations Act if it requires an employee to submit to an investigatory interview and denies the employee’s request for union representation.
